Safety Violation Procedure

Procedure for Lake Safety Violations

  • A verbal warning may be issued for a lot’s first (1st) violation each year, unless the violation has caused a possible life threatening issue or if Lake Safety deems the infraction requires a written warning or other disciplinary action. If the 1st violation is severe enough a written warning may be issued, along with other measures listed below, and may require an appearance before the GLOA BOD and can result in suspension of lake privileges for up to 6 months. 
  • A written warning will be issued for a lot’s second (2nd) violation in accordance with the lake Safety Violation Procedures Letter. It will also require the lot owner and/or the person the infraction is against to come to the Grandview Lake Office located at 5150 S. 650 West, Columbus, IN during office hours, or other predetermined time. They must come with their lot’s copy of the Lake Safety Video that has been distributed in the Spring of 2010.  Failure to bring the copy of the video will result in the lot owner having to purchase another copy at $5.00 each. The lot owner will then have to watch the video and take a 15-question test on the rules of Grandview Lake. They will be allowed to only miss 4 answers to successfully pass the test. If they fail to pass, they may elect to watch the video again and retake the test or lose all lake privileges for 7 full days starting immediately. This first written warning could also result in an appearance before the GLOA BOD, and can result in suspension of all, or a portion of lake privileges for up to 6 months.
  • If a second written violation occurs in the same year, all of the above measures will take place again, plus a mandatory meeting with the GLOA BOD. A loss of lake privileges may occur at the discretion of the BOD. The lot owner will also need to have a written “Plan of Action” on how he/she intends to educate their guests on the Lake Safety Rules.
  • If a 3rd written violation occurs in the same year, all of the above measures will take place, plus a mandatory 1-6 months suspension of lake privileges.
  • If a 4th written violation occurs in the same year, all of the above measures will take place, plus a mandatory 2-6 months suspension of lake privileges.
  • The GLOA BOD has the latitude to suspend either the person who incurred the infraction or any and all of the owners of the lot or the entire lot’s privileges with any of the above disciplinary actions.
  • If multiple violations occur at the same time (one stop by Lake Patrol) the violations may be grouped together as one violation at the discretion of Lake Safety.

    A watercraft from your lot was cited by the Lake Patrol or observed by a GLOA member on (date) _________________, 201____, for violating the Grandview Lake Rules and Regulations.  The violation cited was: Page No. ______, Section No. ______, Rule No. ________, as it appears in the Lake Rules and Regulations. on (date) _________________, 201____, for violating the Grandview Lake Rules and Regulations.
                 This letter is to notify you officially of the violation and to request that you take action to make sure that neither you nor any operator of any watercraft registered to your lot violate any rules in the future. 
                 Since documented violations involving watercraft registered to your lot are numerous enough or serious enough to warrant review, the Board will conduct a hearing to determine whether to suspend the rights of all owners of your lot to operate or use any watercraft on Grandview Lake pursuant to Section 8 of the Grandview Lake Rules and Regulations. You and all owners of your lot as well as the operator of the watercraft who committed the violation are requested to attend the hearing. The hearing will be held on _____________________, 201___, at ________ p.m. at the administration building located at 5150 South, 650 West, Columbus, Indiana. If you cannot attend and if you desire to request another hearing date or time, you should immediately call (812) 342-1219 to make this request.
    The Board may or may not grant this request. The Board requires there be no future violations by any operator of any of your watercraft. Any future violations could result in loss of lake privileges for an extended period of time to be determined by the Board.
    Safety on the lake is an absolute priority for the Board, and it is every lot owner’s responsibility to ensure that the Lake Rules and Regulations are observed. Failure to abide by the rules could result in property damage, serious personal injury, or death. Please review carefully the Lake Rules and Regulations and discuss them with each family member, guest, renter, or anyone who has permission to operate watercraft registered to your lot.
